STANDARD TERMS AND CONDITIONS


  • The client explicitly waives its own standard terms and conditions, even if these were drawn up after these standard terms and conditions of registeration. In order to be valid, any derogation must be expressly agreed to in advance in writing.
  • By accessing and using this website ("Site"), you agree to comply with and be bound by the following terms and conditions. If you do not agree to these terms, please refrain from using our Site.

  • 1. Enrollment and Registration

    • Confirmation: Enrollment is confirmed only upon completion of the registration form and receipt of full payment for the selected course.

  • 2. Payment Terms

    • Fees: All course fees are due at the time of registration.

  • 3. Cancellations and Refunds

    • Class Cancellations: In the event that a class is cancelled by CREATESPACE, participants will be notified at least 2 days in advance and offered a full refund or the option to enroll in a future class.
    • Non-Refundable Fees: Registration and course fees are non-refundable.

  • 4. Attendance and Punctuality

    • Missed Classes: No refunds or make-up sessions will be provided for missed classes due to personal reasons.
    • Punctuality: Participants are expected to arrive on time. Late arrivals may not be accommodated.

  • 5. Code of Conduct

    • Behavior: Participants are expected to maintain respectful behavior towards instructors and peers. CREATESPACE reserves the right to dismiss any participant for disruptive or harmful behavior without refund.

  • 6. Liability

    • Personal Belongings: CREATESPACE is not responsible for loss or damage to personal belongings during classes.
    • Injuries: Participants engage in activities at their own risk. CREATESPACE is not liable for any injuries sustained during the course.
    • Assumption of Risk: Participants and their guardians acknowledge that participation in classes involves inherent risks, including but not limited to minor injuries from equipment use. By enrolling, participants voluntarily assume these risks.
    • Release of Liability: To the fullest extent permitted by law, participants and their guardians release and hold harmless CREATESPACE, its employees, instructors, and agents from any and all liability, claims, or demands arising from participation in the classes, except in cases of gross negligence or willful misconduct.
    • Medical Emergencies: In the event of a medical emergency, CREATESPACE will attempt to contact the participant's emergency contact. If unreachable, CREATESPACE is authorized to seek medical treatment, and any associated costs will be the responsibility of the participant's guardians.
    • Insurance: CREATESPACE does not carry medical or accident insurance for participants. Guardians are encouraged to verify that their personal insurance covers the participant during class activities.
    • Indemnification: Participants and their guardians agree to indemnify and hold harmless CREATESPACE from any claims arising out of the participant's own actions during the class.
    • Waiver of Liability: In consideration of being allowed to participate in CREATESPACE programs, I, on behalf of myself, my family, heirs, and assigns, hereby release CREATESPACE, along with its agents and employees, from any liability for injury, loss, or death that may occur to the aforementioned participant while utilizing any facility or equipment, or in any manner associated with participation in the CREATESPACE program, whether now or in the future, resulting from the ordinary negligence of CREATESPACE, its agents, or employees.

  • 7. Media Release

    • Photography and Videography: By enrolling, participants consent to the use of photographs or videos taken during classes for promotional purposes. If you do not consent, please notify us in writing.

  • 8. Privacy

    • Data Protection: Personal information collected during registration will be used solely for administrative purposes and will not be shared with third parties without consent.

  • 9. Changes to Terms

    • Modifications: CREATESPACE reserves the right to update these Terms and Conditions at any time. Participants will be notified of significant changes.

    • Children showing signs of contagious illness will not be permitted to attend.

  • 13. Product Sales Terms and Conditions

    • The following terms apply to the sale of any physical products purchased from CREATESPACE through our website, at events, or through any direct sale channel.

  • 13.1 Product Description

    • CREATESPACE sells small-batch physical products, including 3D-printed novelty, fidget, decorative, and similar consumer items. Product photos are for illustration only. Due to the nature of 3D printing and small-batch production, slight variations in colour, finish, size, texture, seams, layer lines, and appearance may occur and do not constitute defects.

  • 13.2 Intended Use and Safety

    • Products are not intended for children under 3 years of age. Products may contain small parts and may present a choking hazard. Products must be kept away from heat, flame, and pets, and should be inspected before each use. Do not use any product that is cracked, damaged, deformed, worn, or broken. Adult supervision is recommended where appropriate.

  • 13.3  Safety-Critical Use

    • The customer is solely responsible for determining whether a product is appropriate for their intended use.

  • 13.4 Orders and Acceptance

    • All orders are subject to acceptance and availability. CREATESPACE reserves the right to refuse, cancel, or limit any order at its discretion, including in cases of pricing errors, suspected fraud, stock issues, or inaccurate product information. If an order is cancelled after payment has been received, the full amount paid for the cancelled item will be refunded.

  • 13.5 Pricing and Payment

    • All prices are listed in Canadian dollars (CAD). Applicable taxes and shipping charges, if any, will be shown at checkout. The total price displayed and paid at checkout is the final price for that order. Prices may be updated for future orders at any time without notice. Full payment is required before an order is processed or delivered.

  • 13.6 Shipping, Delivery, and Risk

    • Orders are shipped via Canada Post Expedited Parcel unless otherwise stated at checkout. Estimated delivery times within Canada are based on destination: local shipments typically arrive within 1 to 2 business days, regional shipments within 1 to 4 business days, and national shipments within 2 to 8 business days. These delivery times are estimates only and are not guaranteed. CREATESPACE is not responsible for delays caused by carriers, weather, labour disruptions, customs, or other events beyond our reasonable control. Risk of loss or damage passes to the customer upon delivery to the shipping address provided by the customer, or upon pickup if the order is collected in person. Customers are responsible for providing a complete and accurate shipping address.

  • 13.7 Final Sale and Return Policy

    • Due to the small-batch and made-to-order nature of our business, all product sales are final. We do not accept returns, exchanges, or cancellations for change of mind, incorrect selection, buyer’s remorse, preference, minor cosmetic variation, normal wear and tear, or damage caused by misuse, accidental damage, improper storage, heat exposure, rough handling, pets, or use contrary to instructions.

  • 13.8 Damaged, Defective, or Incorrect Items

    • If a product arrives damaged, materially defective, or incorrect, the customer must contact CREATESPACE within 7 days of delivery or pickup at info@createspaceacademy.ca and provide the order number, a description of the issue, and clear photographs. At our discretion, we may offer a replacement, store credit, repair, or refund for the affected item. We may require the item to be returned if reasonably necessary to assess the issue.

  • 13.9 Customer Responsibility

    • By purchasing and using any product, the customer acknowledges that physical products may break, wear, deform, or fail if misused, dropped, exposed to heat, chewed, bent, over-stressed, modified, or used for unintended purposes. The customer agrees to use all products only as directed and at their own discretion and risk.

  • 13.10 Disclaimer

    • To the fullest extent permitted by applicable law, and except as expressly stated in these terms, all products are provided on an “as is” and “as available” basis. CREATESPACE disclaims all representations, conditions, and warranties, express or implied, including any implied warranty or condition of merchantability, durability, fitness for a particular purpose, title, compatibility, or non-infringement, except to the extent such disclaimers are prohibited by law.

  • 13.11 Limitation of Liability

    • To the fullest extent permitted by applicable law, CREATESPACE, its owners, employees, agents, and representatives will not be liable for any indirect, incidental, special, punitive, or consequential damages, including loss of use, loss of enjoyment, loss of data, loss of revenue, or loss of profits, arising out of or related to any product purchased from us. To the fullest extent permitted by applicable law, the total aggregate liability of CREATESPACE arising out of or relating to any product, order, or claim shall be limited to the amount actually paid by the customer for the specific product giving rise to the claim.

  • 13.12 Assumption of Risk

    • By purchasing, accepting, or using any product sold by CREATESPACE, the customer acknowledges that use of physical products carries inherent risks, including the risk of breakage, wear, small-part hazards, and injury or property damage resulting from misuse, unintended use, modification, lack of supervision, or failure to follow warnings and instructions. The customer voluntarily assumes all such risks to the fullest extent permitted by law.
